Transport is a means to move goods or
people from one place to the desired place. Along with the rapid development of
technology, there emerged a transportation-based application commonly referred
to as an online taxi. Application provider companies invite vehicle owners to
become their partners. This online taxi operates for some time without any
clear rules, so that the Minister of Transportation’s Regulation Number 108 of
2017 was made. The government established a legal umbrella for online taxi partners
by issuing Minister of Transportation’s Regulation No. 108 of 2017. After this
regulation, partners (especially in Surabaya) objected because they were
required vehicle testing, vehicle number registration in the name of legal
entities, and General A Driving License.
The purpose of this study was to analyze
the problematic implementation of Minister of the Transportation’s Regulation
No. 108 of 2017in Surabaya and to analyze the efforts of the Surabaya
Transportation Department in facilitating online taxi drivers and public
transportation in implementing the Minister of Transportation’s Regulation No.
108 of 2017. This research was conducted in an empirical juridical manner,
namely by reviewing the applicable legal provisions and what happened in reality
in the community. This research is conducted by processing information from
informants who experience and know information about a problem and present
data.
The results of the study show that the
Minister of Transportation’s Regulation Number 108 of 2017 was made to become a
legal umbrella for online taxi partners to make clear their licenses.
Regulations regarding vehicle testing, vehicle number registration in the name
of legal entities, and General A Driving License are still not considered the best
way because they cause objections to partners who want to work as the main
livelihood and for partners who want to make this as a side job.Before the
existing regulations, the partners also experienced unpleasant treatment from
conventional transport drivers to experience vehicle damage during passenger
pickup because they were considered to occupy the pickup area of conventional
transport. If this regulation still has to be adhered to, stickers sticking to
the front and rearwindow of online taxi vehicles will make conventional
transportation easier to damage the vehicle. The partners want a sure guarantee
if they have fulfilled the permit requirements, which is to be able to take
passengers anywhere without any restrictions because they feel that if the partners
have fulfilled the permit conditions then it has become the same as
conventional transportation. The cooperative in Surabaya was formed to oversee
partners who want to register themselves as online taxi partners with several
forms of cooperation. The facilities provided by the Ministry of Transportation
are still not evenly distributed because in practice there are partners who
have to pay dearly to make their own General A Driving License (not
collectively).
The Surabaya
Transportation Department should carry out vehicle inspections based on
existing data regarding partner names, type of vehicle used, vehicle color, and
vehicle number plate. Application provider companies must check the
authenticity of the accounts owned by partners, because there are still many
partners who are buying and selling accounts. The partners must express their
opinions in a peaceful manner and ensure the safety and comfort of passengers.
