IMPLEMENTASI PEMBERIAN JASA OLEH PPAT TANPA MEMUNGUT BIAYA KEPADA ORANG YANG TIDAK MAMPU DI KABUPATEN GRESIK

IMPLEMENTATION OF SERVICE PROVISION BY PPAT WITHOUT CHARGING FEES TO UNDERPRIVILEGED PEOPLE IN GRESIK REGENCY

Pejabat Pembuat Akta Tanah memiliki kewajiban untuk memberikan jasa pembuatan akta tanpa memungut biaya kepada orang yang tidak mampu berdasarkan PP Nomor 24 Tahun 2016, Seorang ibu yang tergolong dalam seseorang yang tidak mampu di Kabupaten Gresik tidak mengetahui mengenai jasa pembuatan akta gratis tersebut sehingga dalam membuat akta hibah dikenakan biaya oleh PPAT. Penelitian ini merupakan penelitian hukum empiris yaitu penelitian tentang berlakunya hukum di masyarakat dengan data primer dari wawancara dan data sekunder dari bahan hukum primer dan sekunder. Penelitian ini bertujuan untuk mengetahui terkait implementasi pemberian jasa tanpa dipungut biaya oleh PPAT kepada orang yang tidak mampu beserta faktor penghambatnya di Kabupaten Gresik. Hasil penelitian menunjukkan bahwa implementasi pemberian jasa hukum kepada orang yang tidak mampu di Kabupaten Gresik terlaksana, namun terbatas pada program dari instansi pemerintahan terkait. Faktor penghambat pada impementasi tersebut adalah kendala pada administratif dan birokratis beserta sumber daya yang dimiliki oleh PPAT. Saran untuk masyarakat diperlukan upaya untuk meningkatkan kesadaran masyarakat melalui penyuluhan dan kampanye informasi terkait hak mereka dalam mendapatkan jasa gratis tersebut. Untuk PPAT memperkuat Kerjasama dengan BPN dan Lembaga Swadaya Masyarakat untuk memperluas jangkauan jasa hukum gratis tersebut.

A Land Deed Official is obliged to provide deed-making services without charging fees to the underprivileged based on Government Regulation Number 24 of 2016. A mother, classified as underprivileged in Gresik Regency, was unaware of this free deed-making service, resulting in being charged by the Land Deed Official for creating a grant deed. This research is empirical legal research, which studies the implementation of law in society, using primary data from interviews and secondary data from primary and secondary legal materials. This study aims to understand the implementation of providing free services by the Land Deed Official to the underprivileged and the factors that hinder it in Gresik Regency. The results indicate that the implementation of legal services to the underprivileged in Gresik Regency is carried out but is limited to programs from related government agencies. The inhibiting factors include administrative and bureaucratic obstacles and the resources owned by the Land Deed Officials. Recommendations for the community include efforts to raise awareness through outreach and information campaigns regarding their right to receive free services. For Land Deed Officials, it is suggested to strengthen cooperation with the National Land Agency and Non-Governmental Organizations to expand the reach of these free legal services.
