The Future Arrangements Regarding Village Head Election Results Disputes Based on the Principle of Contante Justitie
Penelitian ini merupakan penelitian hukum normatif yang bertujuan untuk menganalisis pengaturan perselisihan hasil pemilihan kepala desa sebagaimana diatur dalam Pasal 37 ayat (6) Undang-Undang Desa, dengan mengaitkannya pada asas contante justitie. Penelitian ini menggunakan bahan hukum primer, sekunder, dan tersier, serta pendekatan konseptual dan peraturan perundang-undangan. Hasil penelitian menunjukkan bahwa penyelesaian perselisihan hasil pemilihan kepala desa yang diatur dalam Pasal 37 ayat (6) UU Desa dan Pasal 41 ayat (7) dalam Peraturan Pemerintah No. 47 Tahun 2015 belum sepenuhnya sesuai dengan asas contante justitie atau speedy trial. Hal ini disebabkan oleh fakta bahwa penyelesaian perselisihan seringkali berlanjut di Pengadilan Tata Usaha Negara (PTUN) setelah batas waktu 30 hari. Oleh karena itu, diperlukan pengaturan ke depan untuk mewujudkan asas speedy trial dalam perselisihan hasil pemilihan kepala desa. Rekomendasi yang diusulkan mencakup penegasan larangan bagi Bupati atau Walikota untuk melantik Kepala Desa terpilih selama proses perselisihan masih berlangsung di PTUN, penyederhanaan batas waktu penyelesaian perselisihan, serta pembentukan pengadilan khusus ad-hoc untuk menangani perselisihan hasil pemilihan kepala desa. Penelitian ini merekomendasikan revisi terhadap beberapa peraturan perundang-undangan, khususnya Pasal 37 ayat (6) UU Desa, untuk memastikan keadilan dan kepastian hukum dalam proses pemilihan kepala desa.
This research is a normative legal research that aims to analyze the regulation of village head election results disputes as regulated in Article 37 paragraph (6) of the Village Law, by linking it to the principle of contante justitie. This research uses primary, secondary, and tertiary legal materials, as well as conceptual approaches and laws and regulations. The results of the study indicate that the settlement of village head election results disputes regulated in Article 37 paragraph (6) of the Village Law and Article 41 paragraph (7) in Government Regulation No. 47 of 2015 is not fully in accordance with the principle of contante justitie or speedy trial. This is due to the fact that dispute resolution often continues in the State Administrative Court (PTUN) after the 30-day deadline. Therefore, future arrangements are needed to realize the principle of speedy trial in village head election results disputes. The proposed recommendations include affirming the prohibition for the Regent or Mayor to inaugurate the elected Village Head while the dispute process is still ongoing at the PTUN, simplifying the time limit for dispute resolution, and establishing a special ad-hoc court to handle disputes over the results of the village head election. This study recommends revising several laws and regulations, especially Article 37 paragraph (6) of the Village Law, to ensure justice and legal certainty in the village head election process.
