menganalisis implikasi yuridis pencabutan hak imunitas jaksa berdasarkan
Putusan Mahkamah Konstitusi Nomor 15 PUU XXIII 2025 serta meninjaunya dari
perspektif prinsip negara hukum dan equality
before the law. Jaksa memiliki peran strategis dalam sistem
peradilan pidana sehingga memerlukan perlindungan hukum untuk menjamin
independensi dalam menjalankan tugas. Namun, keberadaan hak imunitas berpotensi
menimbulkan hambatan akuntabilitas dan perlakuan khusus yang bertentangan
dengan prinsip persamaan di hadapan hukum. Penelitian ini menggunakan metode
yuridis normatif dengan pendekatan perundang undangan, konseptual, dan kasus.
Data dianalisis melalui penafsiran hukum terhadap peraturan, putusan
pengadilan, dan doktrin yang relevan. Hasil penelitian menunjukkan bahwa hak
imunitas jaksa merupakan imunitas fungsional yang bersifat terbatas dan tidak
memberikan kekebalan mutlak. Persyaratan persetujuan Jaksa Agung dalam proses
hukum terhadap jaksa berpotensi menimbulkan konflik kepentingan, keterlambatan
penegakan hukum, dan risiko impunitas. Putusan Mahkamah Konstitusi dipandang
sebagai upaya menyeimbangkan kebutuhan perlindungan independensi jaksa dengan
tuntutan akuntabilitas serta persamaan di hadapan hukum. Oleh karena itu,
diperlukan pengaturan imunitas yang lebih terbatas, penguatan mekanisme
pengawasan, dan penegasan pengecualian terhadap perlindungan imunitas guna
menjamin tegaknya prinsip negara hukum.

This study analyzes
the juridical implications of the revocation of prosecutorial immunity rights
following Constitutional Court Decision Number 15 PUU XXIII 2025 and examines
it from the perspectives of the rule of law and the principle of equality before the law.
Prosecutors play a strategic role in the criminal justice system and therefore
require legal protection to ensure their independence in carrying out official
duties. However, the existence of immunity rights may create obstacles to
accountability and lead to preferential treatment that is inconsistent with the
principle of equality before the law. This research employs a normative
juridical method using statutory, conceptual, and case approaches. Data were
analyzed through legal interpretation of relevant legislation, court decisions,
and legal doctrines. The findings indicate that prosecutorial immunity
constitutes a limited functional immunity rather than absolute immunity. The
requirement of obtaining approval from the Attorney General before initiating
legal proceedings against a prosecutor has the potential to create conflicts of
interest, delays in law enforcement, and risks of impunity. The Constitutional
Court’s decision is viewed as an effort to balance the need to protect
prosecutorial independence with the demands of accountability and equality
before the law. Therefore, a more limited immunity framework, strengthened
oversight mechanisms, and clear exceptions to immunity protections are
necessary to uphold the rule of law.
