IMPLEMENTASI HAK PEKERJA TERKAIT HAK WAKTU KERJA PEKERJA KAFE DI KABUPATEN BANGKALAN
IMPLEMENTATION OF WORKERS' RIGHTS RELATED TO WORKING TIME RIGHTS OF CAFE WORKERS IN BANGKALAN REGENCY
Pengusaha wajib melaksanakan ketentuan waktu kerja sesuai Pasal 77 ayat (1) UU Ketenagakerjaan. Dalam Pasal 77 ayat (2) UU Ketenagakerjaan jo. Pasal 21 ayat (2) PP No. 35/2021 dijelaskan waktu kerja selama seminggu adalah 40 jam, namun masih ada sebanyak 7,2% pekerja yang bekerja melebihi batas waktu yang ditentukan beberapa diantaranya di Stroom Coffee and Dine, Basecamp Café, dan Kedai Pustaka. Penulisan ini bertujuan untuk mengetahui alasan pekerja kafe perlu mendapatkan hak terkait waktu kerja sesuai dengan Peraturan Perundang-undangan yang berlaku dan implementasi hak pekerja kafe di Kabupaten Bangkalan terkait waktu kerja. Metode penulisan menggunakan metode penelitian hukum empiris. Pengumpulan data dengan observasi, wawancara dan dokumentasi. Data dianalisis secara deskriptif kualitatif. Hasil penulisan ini adalah adanya dampak negatif yang didapatkan pekerja kafe apabila bekerja melebihi batas waktu yang sudah ditentukan. Meskipun penjaga pekerja kafe merupakan pekerjaan yang fleksibel saat dilakukan menyesuaikan dengan keramaian kedai kopi dan dianggap sebagai pekerjaan yang spesifik namun dalam pelaksanaannya masih banyak yang melebihi batas waktu kerja yang telah ditentukan oleh Undang-undang. Implementasi waktu kerja di Kabupaten Bangkalan juga belum sesuai dengan ketentuan Pasal Pasal 77 ayat (2) UU Ketenagakerjaan jo. Pasal 21 ayat (2) PP No. 35/2021 yang menerapkan waktu kerja selama 8 jam per hari selama 6 hari kerja, apabila dalam seminggu maka pekerja bekerja selama”48 jam dan belum termasuk lembur serta dengan waktu libur 1 hari

Employers are required to carry out the provisions of working time in accordance with Article 77 paragraph (1) of the Manpower Law. In“Article 77 paragraph (2) of the Manpower Law jo. Article 21 paragraph (2) of PP No. 35/2021 explains that the working time for a week is 40 hours, but there are still as many as 7,2% of workers who work beyond the specified time limit, several of its which is at Stroom Coffee and Dine, Basecamp Café, and Kedai Pustaka. This paper aims to find out the reasons why coffee shop workers need to get rights related to working time in accordance with applicable laws and regulations and the implementation of the rights of coffee shop workers in Kabupaten Bangkalan related to working time. The writing method uses empirical legal research methods. Data collection by observation, interviews and documentation. The data were analyzed descriptively qualitatively. The result of this writing is that there is a negative impact that coffee shop workers get if they work beyond the predetermined time limit. Although the coffee shopkeeper is a flexible job when done in accordance with the crowds of the coffee shop and is considered a specific job, in its implementation there are still many jobs found outside its field of duty. The implementation of working time in those coffee shop is also not in accordance with the provisions of Article 77 paragraph (2) of the Manpower Law”jo. Article 21 paragraph (2) of PP No. 35/2021 which applies working time for 8 hours per day for 6 days of work in a week, so in a week workers work for 48 hours and does not include overtime and 1 day off
