Salah satu program pemerintah untuk memenuhi kebutuhan rumah bagi Masyarakat Berpenghasilan Rendah (MBR) yakni melalui program Kredit Pemilikan Rumah (KPR). Program KPR ini dilakukan dengan membuat perjanjian kredit antara PT. Bank Tabungan Negara (Persero) Tbk. dengan nasabah. Kreditur dan debitur diwajibkan mematuhi ketentuan yang tercantum dalam perjanjian kredit. Permasalahan terjadi ketika debitur mengalihkan rumah KPR tersebut kepada pihak ketiga selaku pembeli tanpa persetujuan tertulis terlebih dahulu dari kreditur, dimana jangka waktu kredit masih dalam masa angsuran. Rumusan masalah dalam penelitian ini adalah 1. Apakah peralihan hak milik atas rumah KPR oleh debitur kepada pihak ketiga diperbolehkan apabila masih dalam masa angsuran? 2. Apa akibat hukum peralihan hak milik atas rumah KPR oleh debitur kepada pihak ketiga sebelum lunas angsuran tanpa persetujuan kreditur? Tujuan dari penelitian ini untuk menganalisis peralihan hak milik atas rumah KPR oleh debitur kepada pihak ketiga yang masih dalam masa angsuran serta untuk menganalisis akibat hukum peralihan hak milik atas rumah KPR oleh debitur kepada pihak ketiga sebelum lunas angsuran tanpa persetujuan kreditur. Penelitian ini menggunakan penelitian hukum normatif. Pendekatan penelitian berupa pendekatan perundang-undangan (statute approach), pendeketan konseptual (conceptual approach), dan pendekatan kasus (case approach). Teknik analisis penelitian ini menggunakan teknik preskriptif. Hasil penelitian menunjukkan bahwa peralihan hak milik atas rumah KPR oleh debitur kepada pihak ketiga bertentangan dengan ketentuan perjanjian kredit juga Undang-Undang Hak Tanggungan. Akibat hukum peralihan hak milik atas rumah KPR oleh debitur kepada pihak ketiga tidak adanya kepastian hukum dikarenakan tidak dapat dilakukan pendaftaran peralihan hak atas tanah secara langsung pada Kantor Pertanahan.
One of the government programs to meet the housing needs of low-income people is through the Home Ownership Credit program. This program is carried out by making a credit agreement between PT Bank Tabungan Negara (Persero) Tbk. and the debtor. Creditors and debtors are required to comply with the provisions stated in the credit agreement. Problems occur when the debtor transfers the credit house to a third party as a buyer without prior written approval from the creditor, where the credit period is still in the installment period. The formulation of the problems in this study are 1. Is the transfer of property rights on credit houses by debtors to third parties allowed if it is still in the installment period? 2. What are the legal consequences of the transfer of property rights to a house of credit by the debtor to a third party before the installment is paid off without the consent of the creditor? The purpose of this research is to analyze the transfer of property rights on credit houses by debtors to third parties who are still in the installment period and to analyze the legal consequences of the transfer of property rights on credit houses by debtors to third parties before the installment is paid off without the consent of the creditor. This research uses normative legal research. The research approaches are statute approach, conceptual approach, and case approach. This research analysis technique uses prescriptive techniques. The results showed that the transfer of ownership rights to credit houses by debtors to third parties was contrary to the provisions of the credit agreement as well as the Mortgage Law. The legal consequences of the transfer of property rights on credit houses by debtors to third parties are the absence of legal certainty because the transfer of land rights cannot be registered directly at the Land Office.
