Pasal 5 Peraturan Menteri Pekerjaan Umum Dan Perumahan Rakyat Republik Indonesia Nomor 28/Prt/M/2015 Tentang Penetapan Garis Sempadan Sungai Dan Garis Sempadan Danau telah menetapkan mengenai lebar garis sempadan sungai. Faktanya, bangunan masih berdiri di sepanjang Daerah Aliran Sungai Brantas di Kawasan Bendung Gunung Sari Surabaya yang melebihi batas lebar garis sempadan sungai. Penelitian ini bertujuan untuk menganalisis penegakan hukum terhadap larangan mendirikan bangunan di Daerah Aliran Sungai Brantas di Kawasan Bendung Gunung Sari Surabaya serta kendala yang dihadapi. Penelitian ini termasuk penelitian yuridis empiris. Sumber data diperoleh dari data primer dan sekunder yang kemudian dianalisis secara deskriptif kualitatif. Hasil penelitian menunjukkan bahwa penegakan hukum terhadap larangan mendirikan bangunan di Daerah Aliran Sungai Brantas di Kawasan Bendung Gunung Sari Surabaya belum dilaksanakan sepenuhnya. Hingga saat ini penegakan hukum tersebut masih sampai pada tahap sosialisasi dan belum dilakukan tindakan lebih lanjut. Telah beberapa kali dilakukan sosialisasi namun tak kunjung diberikan sanksi yang tegas. Selain hal tersebut diatas, penegakan hukum tak kunjung dilakukan sebab terdapat unsur-unsur lain dalam penegakan hukum ini yang belum terpenuhi. Unsur yang belum terpenuhi dalam penegakan hukum tersebut antara lain adalah unsur pembuatan undang-undang, unsur penegak hukum, dan unsur lingkungan. Kendala yang dihadapi dalam penegakan hukum ini antara lain tingkat kesadaran masyarakat yang berada di Daerah Aliran Sungai Brantas di Kawasan Bendung Gunung Sari Surabaya terhadap lingkungan sekitarnya masih rendah, dan juga pengaturan yang belum jelas terkait prosedur penegakan hukum terhadap permukiman di Daerah Aliran Sungai Brantas Oleh Balai Besar Wilayah Sungai Brantas yang selanjunya disebut BBWS Brantas, serta sumber daya manusia dan jumlah petugas yang relatif masih sangat terbatas untuk melakukan penegakan. Adapun saran yang diberikan penulis antara lain pertama, BBWS Brantas harus segera mengusulkan aturan baru terkait prosedur penegakan hukum terhadap pelanggar yang mengakibatkan rusaknya daya guna air. Kedua, Pemerintah Provinsi Jawa Timur dalam tahun anggaran 2020 dapat menambah kebutuhan anggota Satpol PP sehingga kegiatan penertiban di Daerah Aliran Sungai Brantas dapat segera direalisasikan. Ketiga, Pemerintah Kota Surabaya perlu segera menetapkan tempat relokasi untuk masyarakat yang menghuni sempadan sungai agar segera ada jalan keluar untuk menyelesaikan permasalahan pelanggaran yang dilakukan masyarakat di Daerah Aliran Sungai Brantas. Keempat, BBWS Brantas bersama dinas terkait harusnya dapat memberikan tindakan penertiban yang lebih tegas kepada pelanggar pendirian bangunan di Daerah Aliran Sungai Brantas agar dapat memberikan efek jera.

Article 5 of the Regulation of the Minister of Public Works and Public Housing of the Republic of Indonesia Number 28 / Prt / M / 2015 concerning Determination of River Line and Lake Boundary Line stipulates the width of river border lines. In fact, the building still stands along the Brantas River in the Gunung Sari Surabaya Dam which exceeds the wide border of the river line. This study aims to analyze law enforcement against the prohibition on building in the Brantas River Basin in the Surabaya Gunung Sari Bendung Area and the obstacles faced. This research includes empirical juridical research. Data sources were obtained from primary and secondary data which were then analyzed descriptively qualitatively. The results of the study indicate that law enforcement against the prohibition on building in the Brantas River Basin in the Gunung Sari Bendung Surabaya area has not been fully implemented. Until now, law enforcement is still up to the stage of socialization and no further action has been taken. Socialization has been carried out several times but has not been given strict sanctions. In addition to the above, law enforcement has not been carried out because there are other elements in law enforcement that have not been fulfilled. Elements that have not been fulfilled in law enforcement include elements of law making, law enforcement, and environmental elements. Constraints in this enforcement include the level of public awareness in the Brantas River Basin in the Gunung Sari Surabaya Dam Area to the surrounding environment is still low, and also unclear arrangements regarding law enforcement procedures for settlements in the Brantas River Basin by the Brantas River Regional Office which is called BBWS Brantas, and human resources and the number of officers who are still relatively limited in carrying out enforcement. Recommendations given by the author include the first, BBWS Brantas, as the agency that has authority over the Brantas river, it must immediately propose a new regulation related to law enforcement procedures against offenders which results in damage to water use. Secondly, the East Java Provincial Government in the fiscal year 2020 can add to the needs of members of the Satpol PP so that enforcement activities in the Brantas River Basin can be immediately realized. Third, the Surabaya City Government must immediately establish a relocation site for the people who inhabit the river border so that there is an immediate solution to resolve the violation problems committed by the community in the Brantas River Basin. Fourth, BBWS Brantas and related agencies should be able to provide more stringent enforcement measures to violators of building establishments in the Brantas River Basin in order to provide a deterrent effect.
