Penelitian ini mengkaji dinamika tata kelola sumber daya air di Kota Surabaya yang diwarnai oleh konflik kepentingan antara PDAM Surya Sembada dengan pengembang perumahan elit di kawasan Surabaya Barat dan Selatan. Latar belakang penelitian ini adalah adanya fenomena pengelolaan air bersih secara mandiri oleh pihak pengembang yang tidak terintegrasi dengan jaringan PDAM, sehingga memicu persoalan legalitas hukum terkait Pasal 33 ayat (3) UUD 1945 serta kesenjangan akses layanan antara penghuni kawasan elit dan masyarakat umum. Selain itu, praktik ini berpotensi merugikan Pendapatan Asli Daerah (PAD) dari sektor air bersih.
Tujuan penelitian ini adalah untuk menganalisis akar penyebab konflik tersebut dari aspek regulasi, ekonomi, dan teknis, serta mengevaluasi efektivitas fungsi pengawasan DPRD Kota Surabaya melalui mekanisme hearing, observasi lapangan, dan mediasi dalam merumuskan solusi yang adil bagi seluruh pihak terkait.
Hasil penelitian menunjukkan bahwa konflik dipicu oleh keinginan pengembang untuk menjaga standar layanan eksklusif, namun hal ini dinilai mencederai prinsip keadilan sosial dan kedaulatan negara atas air. DPRD Kota Surabaya, melalui Komisi A, telah menjalankan peran pengawasan secara aktif dengan menyelenggarakan Rapat Dengar Pendapat (RDP) yang melibatkan PDAM, pengembang, dan perwakilan masyarakat (SCWI). Solusi strategis yang dihasilkan meliputi penguatan regulasi melalui Perda Kota Surabaya No. 1 Tahun 2025 yang mewajibkan integrasi layanan air ke jaringan PDAM demi menjamin hak dasar masyarakat dan kepastian hukum dalam pengelolaan utilitas publik di Kota Surabaya.

THE SUPERVISORY ROLE OF THE SURABAYA CITY DPRD IN RESOLUTION OF THE CLEAN WATER MANAGEMENT CONFLICT BETWEEN PDAM SURYA SEMBADA AND ELITE HOUSING DEVELOPER
This study examines the dynamics of water resource governance in the city of Surabaya, which is characterized by a conflict of interest between PDAM Surya Sembada and elite housing developers in the West and South Surabaya areas. The background to this study is the phenomenon of independent clean water management by developers that is not integrated with the PDAM network, thus triggering legal issues related to Article 33 paragraph (3) of the 1945 Constitution and the gap in access to services between residents of elite areas and the general public. In addition, this practice has the potential to harm Regional Original Income (PAD) from the clean water sector.
The purpose of this study is to analyze the root causes of the conflict from regulatory, economic, and technical aspects, as well as to evaluate the effectiveness of the Surabaya City DPRD's supervisory function through hearing mechanisms, field observations, and mediation in formulating fair solutions for all parties involved.
The research results show that the conflict was triggered by the developer's desire to maintain exclusive service standards, but this was deemed to violate the principles of social justice and state sovereignty over water. The Surabaya City Council (DPRD), through Commission A, has actively carried out its oversight role by holding a Public Hearing (RDP) involving the PDAM, the developer, and community representatives (SCWI). The resulting strategic solution includes strengthening regulations through Surabaya City Regulation No. 1 of 2025, which requires the integration of water services into the PDAM network to guarantee the community's basic rights and legal certainty in the management of public utilities in Surabaya City.
