The Rights of Employees Who Voluntarily Resign and Whose Wages Have Not Been Paid (Case Study of the Supreme Court Decision Number 318 K/Pdt.Sus-PHI/2023)
Dalam hubungan kerja, adanya ketidaksesuaian antara pekerja dan pemberi kerja dapat menyebabkan pekerja melakukan pengunduran diri secara sukarela. Hal ini dapat menyebabkan perselisihan hubungan industrial apabila terdapat hak yang belum dipenuhi pemberi kerja kepada pekerja, seperti kasus dalam putusan Mahkamah Agung Nomor 318 K/Pdt.Sus-PHI/2023. Penelitian ini bertujuan untuk menganalisis terkait hak pekerja yang mengundurkan diri secara sukarela yang upahnya belum dibayarkan melalui studi kasus putusan mahkamah agung nomor 318 K/Pdt.Sus-PHI/2023. Jenis peneliatian ini merupakan jenis penelitian normatif dengan pendekatan penelitian peraturan perundang-undangan, pendekatan kasus, dan pendekatan konseptual. Teknik pengumpulan bahan hukum dilakukan dengan cara studi kepustakaan dan dianalisis menggunakan teknik preskriptif. Hasil penelitian didapati bahwa pertimbangan hakim menerapkan Pasal 50 PP 35/2021 dan didukung dengan bukti yang ada, menyatakan pekerja yang mengundurkan diri secara sukarela masih berhak atas upah dan tunjangan hari raya (THR) yang belum dibayarkan serta uang pisah. Hasil penelitian juga menghasilkan bahwa seharusnya pekerja yang mengundurkan diri secara sukarela juga berhak atas uang pergantian hak. Akibat hukumnya putusan ini membatalkan putusan sebelumnya yang menolak gugatan seluruhnya, kemudian Tergugat berkewajiban untuk membayarkan kekurangan upah dan THR, serta uang pisah kepada Para Penggugat.

In an employment relationship, discrepancies between employees and employers can lead to employees voluntarily resigning. This can result in industrial relations disputes if there are rights that the employer has not fulfilled for the employee, as seen in the case of the Supreme Court Decision number 318 K/Pdt.Sus-PHI/2023. This research aims to analyze the rights of employees who voluntarily resign and whose wages have not been paid, through a case study of the Supreme Court decision number 318 K/Pdt.Sus-PHI/2023. This type of research is normative with a legislative, case, and conceptual approach. The technique for collecting legal materials is done through literature study and analyzed using a prescriptive technique. The research findings indicate that the judge's consideration of applying Article 50 of Government Regulation 35/2021, supported by the available evidence, states that employees who voluntarily resign are still entitled to unpaid wages and holiday allowances (THR), as well as severance pay. The research also concludes that employees who voluntarily resign should also be entitled to compensation for rights. The legal consequence of this decision is the annulment of the previous ruling, which rejected the lawsuit in its entirety. Consequently, the Defendant is obligated to pay the unpaid wages and THR, as well as the severance pay, to the Plaintiffs.
