Juridical Analysis Of The Public Prosecutor's Allegations In Decision Number 30/Pid.Sus/2023/Pn.Cbi Concerning Child Protection (Case Study Of “Ayah Sejuta Anak” Foundation)
Anak terlantar berhak mendapatkan kebahagiaan melalui proses adopsi. Proses adopsi di Indonesia dapat dilakukan melalui lembaga pengasuhan anak seperti yayasan maupun panti asuhan. Namun, dalam fenomena di masyarakat masih ada yayasan yang beroperasi secara ilegal seperti pada kasus “Yayasan Sejuta Anak” dalam putusan No. 30/Pid.Sus/2023/PN.Cbi. Yayasan tersebut diduga telah melakukan praktik perdagangan orang berkedok adopsi anak. Penulis tertarik untuk meneliti dakwaan yang diberikan JPU pada Terdakwa Suhendra dalam Putusan No. 30/Pid.Sus/2023/Pn.Cbi tentang Perlindungan Anak. Tujuan dari penelitian ini yaitu untuk mengetahui ketepatan JPU dalam menentukan dakwaannya serta akibat hukum jika terjadi salah penerapan hukum oleh JPU dalam dakwaannya pada Putusan No. 30/Pid.Sus/2023/Pn.Cbi. Penelitian ini dilakukan dengan metode yuridis-normatif serta pendekatan perundang-undangan, pendekatan kasus, dan pendekatan konsep. Pengumpulan bahan hukum dilakukan dengan teknik studi kepustakaan dan dianalisis dengan teknik preskriptif. Hasil pembahasan menunjukan bahwa perbuatan yang dilakukan Terdakwa telah memenuhi unsur-unsur dalam Pasal 2 Ayat (1) UU No. 21 Tahun 2007 tentang Pemberantasan Tindak Pidana Perdagangan Orang. Hal tersebut menunjukan adanya ketidaksesuaian dakwaan JPU, sehingga Hakim Pengadilan Negeri Cibinong menjatuhkan dakwaan kepada Terdakwa dengan pasal yang kurang tepat. Surat dakwaan merupakan dasar pemeriksaan suatu perkara pidana. Maka dari itu, JPU harus lebih cermat dan teliti dalam mencantumkan pasal yang akan didakwakan, sehingga pidana yang dijatuhkan oleh Hakim juga akan sesuai dengan perbuatan Terdakwa.

Abandoned Children have the right to get happiness through the adaption process. In Indonesia, adoption can be carried out through child care institutions such as foundations or orphanages. However, as a phenomenon in society, there are still foundations that operate illegally, as in the case of “Ayah Sejuuta Anak Foundation” in decision Number 30/Pid.Sus/2023/PN.Cbi. The foundation is suspected of carrying out human trafficking practices under the guise of child adoption. The author is interested in examining the charges given by the Prosecutor to Defendant Suhendra in Decision Number 30/Pid.Sus/2023/Pn.Cbi concerning Child Protection. The purpose of this research is to determine the accuracy of the prosecutor in determining his indictment and the legal consequences if there is a misapplication of the law by the prosecutor in his indictment in Decision Number 30/Pid.Sus/2023/Pn.Cbi. This research was conducted using a juridical-normative method as well as a statutory approach, a case approach and a concept approach. The collection of legal materials was carried out using library study techniques and analyzed using prescriptive techniques. The results of the discussion showed that the actions carried out by the Defendant fulfilled the elements in Article 2 Paragraph (1) of the Human Trafficking Law. This shows that there is a discrepancy in the prosecutor's indictment, so that the Cibinong District Court judge handed down the indictment against the defendant with an inaccurate article. The indictment is the basis for examining a criminal case. Therefore, the prosecutor must be more careful and careful in including the articles to be charged, so that the sentence imposed by the judge will also be in accordance with the defendant's actions.
