JUDICIAL DECISION ON THE CRIMINAL ACT OF FRAUD CAUSING CONSUMER LOSS IN ELECTRONIC TRANSACTIONS VIA SOCIAL MEDIA INSTAGRAM: A Case Study of Decision Number 951/Pid.sus/2020/PN JKT.SEL
Perkembangan pesat teknologi telah menggeser pola konsumsi ke transaksi elektronik, yang di satu sisi memberikan kemudahan namun di sisi lain membuka risiko kejahatan siber seperti penipuan yang merugikan konsumen. Penelitian ini mengangkat permasalahan hukum dalam “Putusan Nomor 951/Pid.Sus/2020/PN JKT.SEL”, sebuah kasus penipuan penjualan masker kesehatan fiktif di media sosial Instagram di mana putusan hakim hanya menjatuhkan pidana penjara tanpa adanya pembebanan ganti rugi atau restitusi kepada korban. Penelitian ini menerapkan metode studi yuridis normatif, dengan pendekatan perundang-undangan (statute approach) dan pendekatan kasus (case approach). Sumber bahan hukum yang diterapkan adalah bahan hukum primer dan sekunder , yang dikumpulkan melalui studi dokumen. Seluruh data dianalisis secara kualitatif dengan menggunakan metode interpretasi hukum. Tujuan dilangsungkannya penelitian ini adalah “untuk menganalisis apakah perbuatan terdakwa dapat dikenakan ketentuan Pasal 9 Ayat (1) huruf E Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen (UUPK)”, dan “untuk menganalisis apakah korban berhak mendapatkan restitusi atas kerugian yang diderita berdasarkan Pasal 7A ayat (1) Undang-Undang Nomor 31 Tahun 2014 tentang Perlindungan Saksi dan Korban (UU LPSK).” Hasil penelitian menunjukkan bahwa Perbuatan terdakwa yang menawarkan barang fiktif "seolah-olah tersedia" memenuhi unsur-unsur dalam Pasal 9 Ayat (1) huruf e UUPK, sehingga pelaku usaha dapat dikenai ketentuan tersebut. Korban berstatus sebagai korban tindak pidana penipuan berdasarkan UU ITE dan KUHP , sehingga mereka "berhak memperoleh restitusi" atas "kehilangan kekayaan" sesuai amanat Pasal 7A ayat (1) UU LPSK. Kesimpulan dari penelitian ini adalah bahwa terdakwa dalam kasus ini dapat dijerat dengan UUPK dan para korban secara hukum berhak penuh mendapatkan restitusi, meskipun hak tersebut tidak dikabulkan dalam putusan hakim. Disarankan kepada aparat penegak hukum, khususnya hakim, untuk lebih progresif dalam menerapkan hak restitusi bagi korban kejahatan siber untuk mewujudkan keadilan restoratif, serta kepada masyarakat untuk meningkatkan kehati-hatian dalam melakukan transaksi elektronik.
The rapid development of technology has shifted consumption patterns towards electronic transactions, which on one hand provides convenience, but on the other hand, introduces risks of cybercrime, such as fraud, that is detrimental to consumers. This research addresses the legal issues within “Decision Number 951/Pid.Sus/2020/PN JKT.SEL”, a case concerning the fraudulent sale of fictitious health masks on the social media platform Instagram, where the judge's decision only imposed imprisonment without mandating compensation or restitution for the victims. This research employs a normative juridical research method, utilizing a statutory approach and a case approach. The sources of legal materials used are primary and secondary legal materials, collected through document study. All data were analyzed qualitatively using the legal interpretation method. The objectives of this research are “to analyze whether the defendant's actions can be subjected to the provisions of Article 9 Paragraph (1) letter E of Law Number 8 of 1999 concerning Consumer Protection (UUPK)”, and “to analyze whether the victims are entitled to restitution for the losses suffered based on Article 7A paragraph (1) of Law Number 31 of 2014 concerning Witness and Victim Protection (UU LPSK).” The research results indicate that the defendant's act of offering fictitious goods "as if they were available" fulfills the elements stipulated in Article 9 Paragraph (1) letter e of the UUPK; thus, the business actor can be subjected to these provisions. The victims, possessing the status of victims of the criminal act of fraud under the ITE Law and the Criminal Code (KUHP), are "entitled to obtain restitution" for "loss of property" in accordance with the mandate of Article 7A paragraph (1) of the UU LPSK. The conclusion of this research is that the defendant in this case can be prosecuted under the UUPK, and the victims are, by law, fully entitled to receive restitution, even though this right was not granted in the judge's decision. It is recommended that law enforcement officials, particularly judges, be more progressive in applying the right to restitution for victims of cybercrime to realize restorative justice, and for the public to exercise increased caution when conducting electronic transactions.
