LAW ENFORCEMENT ON THE OBLIGATION TO ISSUE INVESTIGATION PROGRESS NOTIFICATION LETTERS (SP2HP) BY INVESTIGATORS BASED ON ARTICLE 10 PARAGRAPH (5) OF THE REGULATION OF THE CHIEF OF THE NATIONAL POLICE OF THE REPUBLIC OF INDONESIA NUMBER 6 OF 2019 AT THE GENERAL CRIMINAL INVESTIGATION DIRECTORATE OF THE EAST JAVA REGIONAL POLICE
Pelapor dalam proses penyidikan tindak pidana berhak mendapatkan informasi mengenai perkembangan penanganan masalahnya. Hak tersebut dijamin melalui Pasal 10 Ayat (5) Peraturan Kepala Kepolisian Negara Republik Indonesia Nomor 6 Tahun 2019 tentang Penyudikan Tindak Pidana, yang mewajibkan menyelidiki untuk menerbitkan Surat Pemberitahuan Perkembangan Hasil Penyudikan (SP2HP) secara aktif dan berkala kepada pelapor. Namun dalam praktiknya di Ditreskrimum Polda Jawa Timur, pelaksanaan kewajiban tersebut belum berjalan sepenuhnya sesuai dengan kehendak norma, sehingga hak pelapor atas informasi perkembangan hal yang belum terpenuhi secara optimal. Penelitian ini bertujuan untuk menganalisis penegakan hukum terhadap kewajiban penerbitan SP2HP di Ditreskrimum Polda Jawa Timur serta mengidentifikasi faktor pendukung dan penghambat pelaksanaannya. Penelitian ini merupakan penelitian hukum empiris dengan pendekatan sosiologis hukum. Data primer diperoleh melalui wawancara dengan Kasubdit 1 Kamneg, penyidik pembantu, dan pelapor, serta didukung data publikasi SP2HP periode 2023-2026. Teknik analisis yang digunakan adalah analisis kualitatif. Hasil penelitian menunjukkan bahwa secara kuantitatif Ditreskrimum Polda Jawanamun secara kualitatif masih ditemukan permasalahan serius berupa penerbitan yang bersifat reaktif, ketidaksesuaian substansi SP2HP dengan penyelidikan fakta, serta dokumen fisik yang tidak sampai ke pelapor. Faktor pendukung meliputi kejelasan norma, sistem EMP, dan pengawasan berjenjang, sedangkan faktor penghambat Mencakup tingginya beban kerja penyidik, budaya hukum yang belum optimal, dan rendahnya partisipasi masyarakat. Penelitian ini menyimpulkan bahwa penegakan kewajiban SP2HP belum berjalan optimal secara kualitatif dan memberi rekomendasi pembenahan mekanisme distribusi, penyediaan pengawasan penyampaian penyidik, serta sosialisasi sistem EMP kepada masyarakat. Complainants in criminal investigation proceedings have the right to receive information regarding the progress of their case handling. This right is guaranteed under Article 10 Paragraph (5) of the Regulation of the Chief of the National Police of the Republic of Indonesia Number 6 of 2019 on Criminal Investigation, which obliges investigators to actively and periodically issue an Investigation Progress Notification Letter (SP2HP) to complainants. However, in practice at the General Criminal Investigation Directorate of the East Java Regional Police, the implementation of this obligation has not fully aligned with the intent of the norm, leaving complainants' right to case progress information inadequately fulfilled. This study aims to analyze law enforcement regarding the obligation to issue SP2HP at the General Criminal Investigation Directorate of the East Java Regional Police and to identify the supporting and inhibiting factors in its implementation. This research employs an empirical legal method with a sociological approach to law. Primary data were obtained through in-depth interviews with the Head of Subdirectorate 1, an assistant investigator, and a complainant, supported by SP2HP issuance data from 2023 to 2026. Data were analyzed using qualitative analysis techniques. The findings reveal that quantitatively, the directorate issued 9,857 SP2HPs throughout 2023–2026; however, qualitatively, serious issues remain, including reactive issuance practices, discrepancies between SP2HP content and actual investigative facts, and physical documents failing to reach complainants. Supporting factors include normative clarity, the Electronic Investigation Management System (EMP), and hierarchical supervision, while inhibiting factors encompass investigators' excessive workload, suboptimal legal culture, and low public participation. This study concludes that SP2HP obligation enforcement has not been qualitatively optimal and recommends improving distribution mechanisms, strengthening investigator compliance oversight, and intensifying EMP socialization to the public.
