Tindak pidana pornografi melalui media sosial marak terjadi dikehidupan masyarakat saat ini. Kejahatan ini merupakan pelanggaran norma keasusilaan yang dapat merusak tatanan sosial. Putusan Nomor 23/Pid.B/2022/PN. Wts pada Pengadilan Negeri Wates, memutuskan terdakwa terbukti secara sah melanggar Pasal 29 juncto Pasal 4 ayat (1) Undang-Undang Pornografi. Terdapat permasalahan dimana surat dakwaan pada putusan tersebut tidak cermat, jelas, dan lengkap yang dibuat oleh Jaksa Penuntut Umum dan akibat hukum dari surat dakwaan yang dibuat oleh Jaksa Penuntut Umum. Tujuan penelitian untuk mengetahui dan menganalisis surat dakwaan dalam perkara yang diputus dengan Putusan Pengadilan Negeri Wates Nomor 23/Pid.B/2022/PN. Wts sudah sesuai dengan perbuatan terdakwa atau belum, dan untuk mengetahui dan menganalisis apa dampak dari surat dakwaan yang disusun oleh Jaksa Penuntut Umum berkaitan dengan tindak pidana pornografi melalui media sosial dalam Putusan Nomor 23/Pid.B/2022/PN. Wts pada Pengadilan Negeri Wates. Penelitian ini menggunakan metode penelitian yuridis normatit menggunakan pendekatan perundang-undangan, pendekatan kasus, dan pendekatan konseptual.  Dan juga mengumpulkan bahan hukum primer dan sekunder untuk menjawab permasalahan tersebut. Pada Putusan Nomor 23/Pid.B/2022/PN. Wts Jaksa Penuntut Umum dalam tuntutannya yang tercantum pada surat dakwaan untuk terdaka menjatuhi Pasal 29 juncto Pasal 4 ayat (1) Undang-Undang Pornografi kurang tepat, karena terdakwa dalam melakukan tindak pidana menggunakan handphone yang otomatis terhubung dengan internet. Seharusnya Jaksa Penuntut Umum menambah Pasal 27 ayat (1) Undang-Undang ITE. Dan dampak yang akan diberikan dapat menimbulkan ketidakadilan dan ketidakseimbangan antara perbuatan yang telah dilakukan dengan sanksi pidana yang diberikan kepada terdakwa.

The crime of pornography through social media is rampant in today's society. This crime is a violation of the norms of immorality that can damage social order. Decision Number 23/Pid.B/2022/PN. Wts at the Wates District Court, decided that the defendant was legally proven to have violated Article 29 in conjunction with Article 4 paragraph (1) of the Pornography Law. There are problems where the indictment in the decision is not careful, clear, and complete made by the Public Prosecutor and the legal consequences of the indictment made by the Public Prosecutor. The purpose of the research is to find out and analyze the indictment in the case decided by the Wates District Court Decision Number 23/Pid.B/2022/PN. Wts is in accordance with the actions of the defendant or not, and to know and analyze what is the impact of the indictment prepared by the Public Prosecutor in relation to the crime of pornography through social media in Decision Number 23/Pid.B/2022/PN. Wts at the Wates District Court. This research uses a normative juridical research method using a statutory approach, case approach, and conceptual approach.  And also collect primary and secondary legal materials to answer these problems. In Decision Number 23/Pid.B/2022/PN. Wts, the public prosecutor in his charges listed in the indictment for the defendant to be charged with Article 29 in conjunction with Article 4 paragraph (1) of the Pornography Law was not correct, because the defendant in committing the crime was not in accordance with the law. The public prosecutor should have added Article 27 paragraph (1) of the ITE Law. And the impact that will be given can cause injustice and imbalance between the actions that have been committed with the criminal sanctions given to the defendant.
