Hawkers are among the majority of jobs in the informal
sector. Hawkers emerged as a form of business from the community that was not
accommodated in the formal sector because it was caused by a mismatch between
employment with the number of job seekers. The existence of hawkers should be
the solution of unemployment among the people. But in fact, the existence of
hawkers also has a detrimental impact on society. One of them is the
inconvenience of the community as a result os hawkers who sell their activities
not in their proper place. Nowadays, street vendors often find public
transportation such as buses a place to sell. This is clearly not in accordance
with what has been described in regional regulation of Surabaya City number 2
of 2014 concerning the implementation of public order and public peace which
explains that one of the places that should not be used for selling activities.
This study aims to analyze law enforcement against hawkers
selling in public transportation and what are the obstacles encountered in the
process of law enforcement. Type of research used is sociological juridical
research. The data in this research are the result of interview with several
informants and observations obtained in the field. The data collected will be
analyzed descriptively qualitatively.
The result of the study explained that the law
enforcement process by the Surabaya municipal civil service police had not been
optimal for hawkers selling in public transportation. The obstacles faced in
law enforcement efforts against street vendors selling in public transport are
divided into internal and external constraint. Internal constrains include
human resources, facilities and supporting facilities for law enforcement.
External constraints come from people who are not aware of the applicable law.
