BUSINESS LICENSES (IUP2R) BY MARKET MANAGERS

In Surabaya, the existence of the People's
Market in addition to having a positive impact on society, the market also has
a negative side, which is the unlimited freedom to oppressing certain groups.
The Management and Empowerment of the People's Market in Surabaya states that
all public markets must have management permits except the people's markets
managed by the regional government. Public markets in Surabaya number 109
markets and as many as 105 markets that do not have permits yet so this number
is interesting to be studied. Common obstacles that often occur in the public
market, namely the poor licensing process followed by a lack of facilities and
infrastructure to the weak management of public market management. Regional
Government should be ready to examine the issue comprehensively and take firm
action against the people's markets that do not have fulfilled licensing
procedures.
This thesis uses a type of empirical juridical research, which
describes the effectiveness of law enforcement against violations of the
People's Market Management Business License (IUP2R) by the People's Market
Managers and inhibiting and also driving factors in the administrative law
enforcement process against violations of the People's Market Management
Business License (IUP2R) by Market Managers People. The population in this
thesis is the Benowo People's Market, the Sememi
People's Market, and the Kandangan People's Market in the City of Surabaya,
while the sample used is the Surabaya City Trade Service, traders, People's
Market managers and communities around the market in the population. In this
study the authors used the method of interviewing, observation, and
documentation.
The effectiveness of law
enforcement on violations of the People's Market Management Business License
(IUP2R) by the People's Market managers in Surabaya City is still not
effective, administrative law guarantees the implementation of Surabaya City Regulation Number
1 of 2015 concerning Management and Empowerment of the People's Market,
which requires that all public markets in Surabaya to
appl y the People's Market Management Business License
(IUP2R). If viewed from the factors that influence the law, the limiting factor for law enforcement is the problem of
land acquisition for own market management, because the people's market in
Surabaya is still largely managed by the Lembaga Ketahanan
Masyarakat Kelurahan (LKMK)
and land ownership is still privately owned, the foundation or the village's
own land .
