EFEKTIVITAS HUKUM UJI BERKALA PADA KENDARAAN BERMOTOR JENIS PICK UP TERHADAP TERJADINYA KECELAKAAN DI KABUPATEN LAMONGAN

             Kendaraan bermotor sebagai sarana transportasi pendukung dalam kebutuhan masyarakat. Peran dalam lalu lintas dan angkutan jalan sangat penting dalam menunjang, memperlancar dan meningkatkan pembangunan perekonomian baik regional maupun nasional. kebutuhan akan jasa lalu lintas semakin bertambah sehingga jumlah kendaraan bermotor berkembang dan tingkat kecelakaan lalu lintas makin meningkat. Kecelakaan tersebut disebabkan kurang laiknya kendaraan bermotor khususnya jenis Pick Up. Kewajiban melakukan uji berkala yang dilakukan 6 bulan setelah uji berkala pertama telah diatur dalam Peraturan Menteri Perhubungan Republik Indonesia Nomor PM 133 Tahun 2015 Tentang Pengujian Berkala Kendaraan Bermotor. Peraturan Menteri Perhubungan Republik Indonesia Nomor PM 133 Tahun 2015 Tentang Pengujian Berkala Kendaraan Bermotor ini dikeluarkan dengan tujuan agar setiap masyarakat melakukan uji berkala untuk kelayakan dan keamanan saat beroperasi dijalan raya.

Penelitian ini bertujuan untuk menganalisa efektivitas hukum uji berkala kendaraan bermotor jenis Pick up dalam terjadinya kecelakaan dan mendeskripsikan faktor-faktor yang mempengaruhi efektivitas hukum uji berkala kendaraan bermotor jenis Pick Up dalam terjadinya kecelakaan, serta mengkaji upaya yang dilakukan oleh UPT Pengujian Kendaraan Bermotor di Kabupaten Lamongan dalam hal memahami efektivias hukum uji berkala kendaraan bermotor jenis Pick Up. Penelitian ini termasuk penelitian yuridis sosiologi. Sumber data diperoleh dari data primer dan data sekunder dengan metode analisis kualitatif.

            Hasil penelitian menunjukkan efektivitas hukum uji berkala kendaraan bermotor jenis Pick Up terhadap terjadinya kecelakaan di Kabupaten Lamongan sangat rendah. Faktor-faktor yang mempengaruhi efektivitas hukum uji berkala pada kendaraan bermotor jenis Pick Up terhadap terjadinya kecelakaan di Kabupaten Lamongan yaitu faktor hukum, faktor penegak hukum, faktor kebudayaan, faktor sarana dan fasilitas, dan faktor masyarakat. Upaya yang dilakukan UPT Pengujian kendaraan Bermotor di Kabupaten Lamongan hanya sebatas upaya preventif. Upaya Preventif yang dilakukan adalah dengan melakukan oprasi di jalan raya.

ABSTRACT

EFFECTIVENESS OF PERIODIC LAW TEST ON MOTOR VEHICLES TYPES OF PICK UP ON ACCIDENTS IN LAMONGAN DISTRICT

Motorized vehicles as a means of supporting transportation in community needs. The role in traffic and road transport is very important in supporting, facilitating and increasing economic development both regionally and nationally. the need for traffic services is increasing so that the number of motorized vehicles is growing and the level of traffic accidents is increasing. The accident was caused by inadequate motorized vehicles, especially the type of Pick Up. The obligation to conduct periodic tests conducted 6 months after the first periodic tests has been regulated in the Regulation of the Minister of Transportation of the Republic of Indonesia Reupblik Number PM 133 of 2015 concerning Periodic Testing of Motorized Vehicles. Regulation of the Minister of Transportation of the Republic of Indonesia of Reupblik Number PM 133 of 2015 concerning Periodic Testing of Motorized Vehicles is issued with the aim that every community conducts periodic tests for eligibility and safety when operating on the highway.

This study aims to analyze the effectiveness of the legal periodic test of motorized vehicles of pickup type in the occurrence of accidents and describe the factors that influence the effectiveness of the legal periodic tests of motorized vehicles of pickup type in the occurrence of accidents, and examine the efforts made by UPT Motorized Vehicle Testing in Lamongan Regency in terms of understanding the effectiveness of the law on periodic testing of motorized vehicles of the Pick Up type. This research is a sociology juridical research. Sources of data obtained from primary data and secondary data with qualitative analysis methods.

The results of the study showed that the effectiveness of the legal periodic test of Pick Up motor vehicles against accidents in Lamongan District was very low. Factors that influence the effectiveness of periodic legal testing on motorized vehicles Pick Up type of accidents in Lamongan Regency are legal factors, law enforcement factors, cultural factors, facilities and facilities factors, and community factors. The efforts made by UPT for testing motorized vehicles in Lamongan Regency were only limited to preventive efforts. Preventive efforts taken are by conducting operations on the highway.
