ANALISIS PUTUSAN MAHKAMAH AGUNG RI No. 75 K/Ag/2018 ATAS PEMBATALAN PERKAWINAN POLIGAMI TANPA IZIN
ANALYSIS OF THE DECISION OF THE SUPREME COURT No. 75 K/Ag/2018 ON THE NULLIFICATION OF POLIGAMI MARRIAGE WITHOUT PERMISSION
Kutipan buku pendaftaran rujuk, sejalan dengan ketentuan pada Pasal 10 dan 166 KHI, menjadi satu-satunya bukti sah peristiwa rujuk. Meskipun demikian, Putusan No. 1750/Pdt.G/2016/PA.Bm membatalkan perkawinan antara Tergugat I dan Tergugat II berdasarkan bukti rujuk sepihak Penggugat. Ketidakpastian ini muncul karena kurangnya bukti konkret tentang terjadinya rujuk yang dilakukan di luar hadapan PPN. Putusan tingkat banding No. 0068/Pdt.G/2017/PTA.Mtr membatalkan putusan tingkat pertama, karena Majelis Hakim menilai kurangnya bukti rujuk Penggugat. Permohonan Kasasi pada Putusan No. 75 K/Ag/2018 ditolak, Menyatakan ketiadaan bukti rujuk yang sah dan inkonsistensinya saksi atas terjadinya rujuk bil fi’li. Perlu dicatat bahwa dalam Pasal 3 ayat (3) UU No. 22 Tahun 1946 mengandung makna bahwa rujuk tidak harus dilaksanakan dihadapan PPN. Penelitian ini bertujuan untuk menganalisis dasar pertimbangan Majelis Hakim dalam Putusan No. 75 K/Ag/2018 beserta implikasi hukumnya. Metode penelitian yang digunakan adalah Hukum Normatif yang digunakan dengan pendekatan Perundang-undangan, konsep serta kasus. Hasil penelitian menunjukan bahwa putusan No. 75 K/Ag/2018 telah tepat untuk menolak kasasi Penggugat. Ketentuan Pasal 10 dan 166 KHI, Pasal 29 dan Pasal 30 PMA No. 11 Tahun 2007 menegaskan bahwa bukti rujuk hanya dapat diperoleh dari kutipan buku pendaftaran rujuk. Akibat hukum dari putusan ini adalah mempertahankan status perkawinan Tergugat I dengan Tergugat II adalah sah. Sementara itu, perkawinan Penggugat dengan Tergugat I dianggap telah putus berdasarkan akta cerai No. 0350/AC/2014. Implikasi perceraian diatur dalam Pasal 41 Undang-undang Perkawinan dan Pasal 156 KHI, dimana menekankan kewajiban dan hak-hak suami dan Istri, terutama terkait pemeliharaan dan pendidikan anak.

The excerpt of the rujuk registration book, in line with the provisions in Articles 10 and 166 KHI, is the only valid evidence of the rujuk event. Nevertheless, Decision No. 1750/Pdt.G/2016/PA.Bm annulled the marriage between Defendant I and Defendant II based on evidence of the Plaintiff's unilateral reconciliation. This uncertainty arose due to the lack of concrete evidence of the occurrence of rujuk conducted outside the presence of the VAT. Appeal level decision No. 0068/Pdt.G/2017/PTA.Mtr overturned the first instance decision, as the Panel of Judges assessed the lack of evidence of the Plaintiff's reconciliation. The Cassation Petition in Decision No. 75 K/Ag/2018 was rejected, stating the absence of valid evidence of rujuk and the inconsistency of witnesses to the occurrence of rujuk bil fi'li. It should be noted that Article 3 paragraph (3) of Law No. 22/1946 implies that rujuk does not have to be conducted in front of a VAT. This study aims to analyze the reasoning of the Panel of Judges in Decision No. 75 K/Ag/2018 and its legal implications. The research method used is Normative Law which is used with the approach of legislation, concepts and cases. The results showed that the decision No. 75 K/Ag/2018 was right to reject the Plaintiff's cassation. The provisions of Articles 10 and 166 KHI, Article 29 and Article 30 PMA No. 11 of 2007 emphasize that evidence of reconciliation can only be obtained from an excerpt of the reconciliation registration book. The legal effect of this decision is to maintain the marital status of Defendant I and Defendant II as valid. Meanwhile, the Plaintiff's marriage with Defendant I is considered to have broken down based on the divorce certificate No. 0350/AC/2014. The implications of divorce are regulated in Article 41 of the Marriage Law and Article 156 KHI, which emphasizes the obligations and rights of husband and wife, especially regarding the maintenance and education of children.
