Analisis Yuridis Putusan Nomor 809/Pid.Sus/2024/PN DPS Terhadap Tindak Pidana Pemeliharaan Satwa Liar Yang Dilindungi

Habitat satwa di Indonesia memiliki jenis satwa yang secara khusus ditemukan di Indonesia saja atau yang disebut satwa endemik yaitu hewan asli yang hanya ditemukan di Indonesia. Jika satwa endemik punah di Indonesia, berarti hewan tersebut punah di dunia. Skripsi ini didasarkan pada kasus pemeliharaan satwa liar yang dilindungi tanpa izin dalam Putusan Nomor 809/Pid. Sus/2024/PN Dps yang bertujuan untuk mengetahui Putusan Nomor 809/Pid. Sus/2024/PN Dps relevan dengan asas fiksi hukum untuk memahami pertimbangan hakim yang membebaskan terdakwa akibat tidak ada unsur mens rea. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan kasus. Penelitian ini menggunakan bahan hukum primer dan sekunder dengan analisis preskriptif. Hasil pembahasan pada skripsi ini, hakim memutus bebas terdakwa dengan alasan tidak mengetahui dan terdakwa tidak mempunyai niat jahat. Hal ini membuat ketidaksesuaian antara Putusan Hakim dengan Peraturan Perundang-undangan. 

Animal habitats in Indonesia have types of animals that are specifically found in Indonesia alone or what is called endemic animals, which are native animals that are only found in Indonesia. If an endemic animal becomes extinct in Indonesia, it means that the animal is extinct in the world. This thesis is based on the case of keeping protected wildlife without a license in Decision Number 809/Pid. Sus/2024/PN Dps which aims to find out Decision Number 809/Pid. Sus/2024/PN Dps relevant to the principle of legal fiction to understand the judge's consideration of acquitting the defendant due to the absence of mens rea elements. This research uses a normative juridical method with a statutory and case approach. This research uses primary and secondary legal materials with prescriptive analysis. The results of the discussion in this thesis, the judge acquitted the defendant on the grounds that he did not know and the defendant did not have malicious intent. This makes a discrepancy between the Judge's Decision and the Laws and Regulations.
