LEGAL REVIEW OF THE INDEPENDENCE OF CONSTITUTIONAL COURT JUDGES (A Study of Constitutional Court Decision Number 103/PUU-XX/2022)

Uji materiil ini dilakukan oleh Zico Leonard Djagardo S.H. yang merupakan warga negara Indonesia yang berprofesi sebagai Advokat dengan spesialisasi memegang perkara di bidang tata negara. Permohonan ini mengenai Pengujian Undang-Undang Nomor 7 Tahun 2020 tentang Perubahan Ketiga Atas UndangUndang Nomor 24 Tahun 2003 tentang Mahkamah Konstitusi. Permohonan uji materiil ini berawal ketika terjadi pencopotan Hakim Konstitusi Aswanto oleh Dewan Perwakilan Rakyat Republik Indonesia dan digantikan oleh Sekjen MK Guntur Hamzah. Tujuannya adalah untuk menguraikan pertimbangan hukum hakim dan menganalisis akibat hukum putusan menggunakan metode penelitian hukum normatif. Putusan Mahkamah Konstitusi Nomor 103/PUUXX/2022 yang menolak permohonan pemohon untuk seluruhnya dengan pertimbangan hukum majelis hakim Mahkamah Konstitusi yang kurang jelas secara nilai-nilai yuridis yang dirujuk, menunjukan bahwa telah tergerusnya independensi hakim.

This material test was conducted by Zico Leonard Djagardo S.H. who is an Indonesian citizen who works as an Advocate specializing in holding cases in the field of state administration. This application is regarding the Examination of Law Number 7 of 2020 concerning the Third Amendment to Law Number 24 of 2003 concerning the Constitutional Court. This judicial review application originated when there was a removal of Constitutional Judge Aswanto by the House of Representatives of the Republic of Indonesia and was replaced by the Secretary General of the Constitutional Court Guntur Hamzah. The aim is to describe the judge's legal considerations and analyze the legal consequences of the decision using normative legal research methods. The Constitutional Court Decision Number 103/PUU-XX/2022 which rejected the applicant's petition in its entirety with the legal considerations of the Constitutional Court judges who were unclear about the juridical values referred to, showed that the independence of judges had been eroded.
