Wages are the rights of
workers/labourers who are received in the form of money as compensation from
the employer or employer to Worker/Labourer who is determined and paid
according to a work agreement. One of the violations committed by employers is
giving the wages of workers/laborers are below the minimum wage. Whereas in
Article 88E paragraph 2 of the Labor Law is clear State that; “Employers are
prohibited from paying lower wages than that minimum wage, and sanctions
contained in article 185. From 2020 to In 2022 there are 10 complaints that
come to the East Java Province Manpower Office superintendent of wage
violations. The purpose of this research is to find out how the law enforcement
process is carried out by labor inspectors on wages violations committed by
employers, what are the obstacles for labor inspectors, and to find out the
efforts made to overcome the problem of wages. Besides This study also examines
the role of labor law in resolving industrial relations issues. The type of
research used in this study is Empirical Juridical Law research which was
obtained through interviews with the Head of the Law Enforcement Section and
Civil Servant Investigators (PPNS).
The results of the research
discussion it can be concluded that The position of labor law in Indonesia's
national legal system theoretically can separated into 3 fields, namely the
administrative field, the civil
field, and the field criminal field.
The legal relationship between workers/laborers and Entrepreneurs are included
in the field of civil law. However, during the process creating, executing, and
terminating relationships, the government oversees performs 3 functions. If
during the process there is a violation (not in accordance with the applicable
provisions), may be subject to criminal sanctions applied.
