RELEVANSI ASAS ERGA OMNES DAN ASAS KEPASTIAN HUKUM TERHADAP EKSEKUSI PUTUSAN PENGADILAN TATA USAHA NEGARA
THE RELEVANCE OF THE PRINCIPLE OF ERGA OMNES AND THE PRINCIPLE OF LEGAL CERTAINTY TO THE EXECUTION OF ADMINISTRATIVE COURT DECISIONS
Tujuan penelitian ini adalah menganalisis kewajiban Badan Kepegawaian Negara (BKN) dalam melaksanakan putusan PTUN meskipun tidak berkedudukan sebagai pihak tergugat, serta menjelaskan akibat hukum tidak diaktifkannya kembali Nomor Induk Pegawai (NIP) oleh BKN pasca putusan PTUN yang telah berkekuatan hukum tetap, ditinjau dari asas kepastian hukum dalam Asas-Asas Umum Pemerintahan yang Baik. Metode penelitian yang digunakan adalah penelitian yuridis normatif dengan pendekatan peraturan perundang-undangan, konseptual, dan kasus. Hasil penelitian menunjukkan bahwa putusan PTUN memiliki kekuatan mengikat berdasarkan asas res judicata pro veritate habetur kewenangan administratif bagi BKN meskipun tidak berkedudukan sebagai pihak tergugat. Tidak diaktifkannya kembali NIP pasca putusan PTUN menimbulkan ketidakpastian hukum bagi status kepegawaian Ahmadi dkk. sebagai PNS. Saran penelitian ini adalah BKN melaksanakan putusan PTUN yang telah berkekuatan hukum tetap agar BKN melaksanakan putusan PTUN yang telah berkekuatan hukum tetap, dan Ahmadi dkk. dapat berkoordinasi dengan LKBH KORPRI serta mengajukan upaya administratif kepada Badan Kepegawaian Negara atau mengajukan gugatan ke Pengadilan Tata Usaha Negara terhadap tindakan faktual BKN sesuai dengan ketentuan peraturan perundang-undangan.

The purpose of this study is to analyze the obligations of the State Civil Service Agency (BKN) in implementing the Administrative Court's decision even though it is not a defendant, as well as to explain the legal consequences of the BKN not reactivating the Employee Identification Number (NIP) after the Administrative Court's decision has become final and binding, reviewed from the principle of legal certainty in the General Principles of Good Governance. The research method used is normative legal research with a regulatory, conceptual, and case approach. The results of the study show that the Administrative Court's decision is binding based on the principle of res judicata pro veritate habetur and is erga omnes in nature, thereby giving administrative authority to the BKN even though it is not a defendant. The failure to reactivate the NIP after the Administrative Court's decision has created legal uncertainty regarding the civil servant status of Ahmadi et al. This study recommends that the BKN implement the PTUN decision that has permanent legal force so that the BKN implements the PTUN decision that has permanent legal force, and Ahmadi et al. can coordinate with the LKBH KORPRI and file an administrative appeal with the State Civil Service Agency or file a lawsuit with the State Administrative Court against the factual actions of the BKN in accordance with the provisions of laws and regulations.
