DAMPAK PENCABUTAN PROGRAM ASIMILASI RUMAH PADA LEMBAGA PEMASYARAKATAN KELAS 1 SURABAYA

Asimilasi rumah sendiri berdasarkan situs menpan.go.id merupakan langkah khusus yang dilaksanakan oleh pemerintahan lewat Kementerian Hukum dan HAM (Kemenkumham) dalam mencegah Overcapacity di dalam lapas maupun rutan.dengan mekanisme yang dimana narapidana dapat pulang terlebih dahulu namun dengan adanya Kepmenkumham Nomor M.HH - 186.PK.05.09 Tahun 2022 maka asimilasi rumah dicabut, hal tersebut berpotensi menimbulkan masalah pada lapas terkait overcapacity pada lapas.Penelitian ini, seperti yang dijelaskan diatas yaitu penelitian ini berjenis penelitian hukum secara empiris, analisis secara sosiologis hukum artinya pendekatan dengan analisis terkait respon dan tanggapan yang terjadi saat sistem hukum tersebut sudah berjalan. dari pencabutan program asimilasi rumah berdasarkan pada Kepmenkumham Nomor M.HH - 186.PK.05.09 Tahun 2022 yang dimana prosesdur kembali sepeerti semula, yang artinya narapidana harus menunggu SK PB didalam lapas. sehingga hal tersebut bisa menimbulkan overcapacity pada lapas. hal tersebut berdasarkan pada data jumlah narapidana yang seharusnya bisa mendapatkan asimilasi rumah namun dengan dicabutnya asimilasi rumah dan data jumlah narapidana yang masuk di lapas Berdasarkan pembahasan diatas dapat disimpulkan bahwasanya asimilasi rumah dapat membawa dampak terhadap Lembaga pemasyarakatan dan narapidana, yang dimana narapidana dapat pulang lebih awal namun dengan catatan mennunggu SK PB dan diawasi oleh bapas, sehingga dapat mengurangi overcapacity pada lapas.serta dicabutnya asimilasi rumah maka akan menimbulkan overcapacity pada lapas.
